Terms of Service

1. Purpose and Agreement

1. PurposeThese Terms of Service (“Terms”) govern the conditions and procedures for using the Seemilar service (“Service”), which is operated by Seemilar Co.,Ltd. (“Company”). Seemilar is provided as a multi-platform service (including but not limited to mobile applications, web applications, and other compatible devices) through https://www.seemilar.com (“Website”). These Terms define the rights, obligations, and responsibilities between Seemilar and its members.
2. Effect of TermsBy accessing or using the Service, you enter into a complete and binding agreement with Seemilar, replacing all prior agreements. If you do not agree to these Terms, you must not use the Service.
3. AmendmentsSeemilar may update these Terms to improve the Service, ensure safety, or comply with applicable laws. Revised Terms will be notified at least 30 days in advance (e.g., via the Website), and continued use of the Service constitutes your acceptance of the revised Terms.

2. Provision of the Service

1. Scope of ServiceSeemilar provides products, features, and software including (but not limited to): member management, workspace and project management, content storage and management, sharing and collaboration, notifications and integrations, and data security and backups.
2. Personalized ExperienceSeemilar may use data about your activities, settings, and participation in workspaces and projects to provide a customized experience.
3. Global OperationsSeemilar operates a global infrastructure. To deliver the Service, your information may be stored, transferred, and distributed worldwide (including outside your country of residence). This is essential to provide the Service.

3. Member Obligations and Restrictions

1. EligibilityMembers must be at least 13 years old (or the minimum legal age in their country).
2. Prohibited ConductMembers must not engage in or share the following:
  • Illegal or fraudulent activities: Conduct that is unlawful, misleading, or deceptive.
  • Intellectual property infringement: Violating others’ copyrights or trademarks.
  • System abuse: Uploading viruses or otherwise harming system integrity or operation.
  • Unauthorized data collection: Using automated means to access or collect Service data without Seemilar’s prior permission.
  • Account misuse: Sharing passwords, granting third-party access, transferring accounts, or requesting/collecting usernames or passwords.
  • Violation of policies: Breaching these Terms or community guidelines.

4. Rights and Licenses

1. Content OwnershipYou retain ownership of any content you upload or create (links, images, videos, etc.) and are solely responsible for its use.
2. License to SeemilarBy sharing, posting, or uploading content, you grant Seemilar a non-exclusive, transferable, royalty-free, worldwide license to host, use, distribute, modify, run, copy, translate, and create derivative works of your content for the purpose of providing and improving the Service. This license ends when the content is fully deleted from Seemilar systems.
3. Advertising UseYou grant Seemilar the right to use your name, profile photo, and activity information (e.g., likes, follows) alongside ads, offers, and promotional content displayed across Seemilar products, free of charge.
4. Software UpdatesWhen you download or use Seemilar software, you authorize Seemilar to download and install updates where available.

5. Account Termination and Data Handling

1. Seemilar ActionsIf Seemilar determines you have clearly, seriously, or repeatedly violated these Terms or policies, it may temporarily suspend or permanently deactivate or delete your account.
2. Dormant AccountsAccounts that remain inactive for a long period (e.g., 30-day inactivity warnings) or are used without your consent may be disabled or deleted.
3. Deletion Requests
  • Upon your request, all personal data will be deleted immediately.
  • Due to the nature of backup and log systems, deleted data may persist for up to 90 days.
  • Content created in workspaces by former members remains in the owner’s workspace, with the author displayed as “Former member.”
4. Data Retention ExceptionsContent may be retained for a limited time if necessary to:
  • Investigate or address illegal activity or Terms violations.
  • Protect product, system, and user safety and security.
  • Comply with legal obligations (including financial records) or law-enforcement requests.

6. Limitation of Liability and Dispute Resolution

1. DisclaimerThe Service is provided “as is.” Seemilar does not warrant that it will always be safe, error-free, or uninterrupted, and disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose.
2. Indirect DamagesSeemilar is not liable for lost profits, revenues, data, or any consequential, special, indirect, or punitive damages arising from or related to these Terms or the Service.
3. Governing Law and JurisdictionIf you are a consumer, the laws of your country of residence and its courts may apply. In all other cases, the laws of the State of California (without regard to conflict of laws) may apply.
